Numerous products sold at major retailers like Walmart, Target, and Amazon are the focus of extensive litigation for containing harmful, carcinogenic ingredients, such as phthalates and formaldehyde. The products are heavily marketed to women of color and often feature images of Black women and girls with silky straight hair. In addition to L’Oréal and Revlon, several smaller companies have been named in the lawsuits, including some based in India.
Individuals who’ve used any of the named products at least four times per year, and developed any of the following, may be entitled to compensation:
The first lawsuit against L’Oréal was filed in October 2022 by Jenny Mitchell, who claimed its chemical hair straightening products caused her uterine cancer. The claim was filed shortly after a study by the Journal of the National Cancer Institute found that women who use hair-straightening chemical products multiple times a year are more than 2 times more likely to develop uterine cancer.
The case has since gained significant momentum, and on November 13th, 2023, a federal judge ruled the majority of the claims in over 8,000 related lawsuits could move forward to trial. Accusations against L’Oréal, Revlon, and other companies include negligence, defective product design, and failure to warn consumers about the risks associated with their hair relaxer products.
Because holding thousands of trials would be impractical, a small number of cases, called bellwether trials, will be held to help inform possible outcomes and settlement amounts for the others.
If you or a loved one believe your cancer may have been caused by a chemical hair relaxer or straightener, we encourage you to take action by filling out a form. We are determined to obtain fair and full compensation for your pain and suffering and help you move forward with your life.
